If you check the comments of the article you linked to, one of the comments is by Olly Moss. Olly is the listed creator on Threadless for the shirt, and he claims that he is the original designer based on a thread he started nearly 3 years ago. Indeed, the thread creator is in fact, Olly Moss.

It seems that this shirt has been dugg, and made it to the top 10 list. After checking the comments, it seems that someone else noticed the shirt is similar to Tom Brazelton's. However, at this point I would say Olly is the original owner of the content, who may well have been inspired after seeing Tom's creation. Incidentally, I think I saw Tom's shirt at some stage, but I never bothered to read it because of the bad design.
